Noxa Terms of Use

1. Agreement to These Terms

These Terms of Use ("Terms") govern your access to and use of the Noxa mobile application, website, backend services, and related features (collectively, the "Service").

The Service is provided by Deepak Kolli, operating Noxa ("Noxa," "we," "us," or "our"), based in Massachusetts, United States.

By creating an account, purchasing a subscription, or using Noxa, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Service.

Your use of the iOS application is also subject to Apple's applicable App Store terms and, unless a custom EULA is provided in App Store Connect, Apple's Standard End User License Agreement ("Apple Standard EULA").

2. Eligibility

You must be at least 13 years old to use Noxa.

If the law where you live requires you to be older to consent to online services or the processing of personal information, you may use Noxa only if you meet that requirement or have any legally required permission from a parent or legal guardian.

If you are under the age of majority where you live, your parent or legal guardian may be responsible for your use of the Service where applicable.

Noxa is not currently intended to function as a parental-control service for controlling another person's device or as an enterprise device-management service.

3. What Noxa Does

Noxa is a digital wellbeing and productivity app designed to help you reduce distractions, manage screen habits, and focus more intentionally.

Depending on the current version of the Service and the features included with your subscription, Noxa may allow you to:

• create focus sessions;
• select apps or app categories to restrict during a focus session;
• configure supported daily usage limits;
• restrict selected websites;
• view focus-session history and statistics;
• synchronize supported website-blocking configuration through your Noxa account; and
• access other productivity or digital-wellbeing features that Noxa may add over time.

Noxa relies in part on Apple technologies such as Family Controls, Managed Settings, Device Activity, StoreKit, and other iOS services. These Apple technologies are underlying platform capabilities used as part of the Noxa experience. Noxa does not sell or separately charge for access to Apple APIs themselves.

4. Accounts

Noxa may require an account to access some or all features of the Service.

You agree to:

• provide accurate information where requested;
• keep your login credentials secure;
• promptly notify us if you believe your account has been compromised; and
• use only accounts that you are authorized to use.

Noxa supports authentication through Sign in with Apple and email-based authentication using Supabase Auth.

You are responsible for activity performed through your account unless applicable law provides otherwise.

5. Screen Time Authorization and Device Permissions

Noxa requires certain Apple permissions to provide blocking and usage-limit features.

You choose whether to authorize these permissions through iOS.

If you deny, revoke, or disable required Screen Time authorization, some or all blocking and usage-limit features may stop functioning.

You acknowledge that:

• Apple controls the underlying operating-system APIs;
• Apple may change, restrict, interrupt, or discontinue API behavior;
• iOS settings or permission changes may disable restrictions;
• operating-system bugs, restarts, extension failures, or other technical conditions may affect enforcement; and
• Noxa cannot guarantee that every block or limit will be impossible to bypass under every circumstance.

Noxa is designed to help you manage your own digital habits. It is not a security system, emergency control system, medical device, or guarantee that another app or website will remain inaccessible.

6. Focus Sessions and Blocking Behavior

When you start a focus session, Noxa may apply the app, category, and website restrictions configured for that session.

During an active session:

• certain blocked apps or websites may remain restricted until the session ends;
• changes that would remove an item from the active blocklist may take effect only after the current session ends;
• changes to future session settings may not modify the active session; and
• you may be offered a way to end the session early, subject to the current product design.

If you end a session early, Noxa may record the actual time focused and mark the session as ended early rather than completed.

Noxa may use reasonable confirmation steps or friction before ending a session early to reduce accidental or impulsive termination.

You remain in control of your device and can revoke Noxa's Screen Time authorization through iOS where Apple permits.

7. Daily Usage Limits

Noxa may let you configure daily usage limits for selected applications or categories.

Usage-limit behavior depends on Apple's Screen Time APIs and may not operate identically across all iOS versions, devices, or circumstances.

Threshold events, resets, and blocking behavior may be affected by Apple system behavior outside Noxa's direct control.

Noxa does not guarantee exact measurement of third-party app usage beyond what Apple's supported APIs provide.

8. Website Blocking

Noxa may allow you to configure website domains to restrict during focus sessions or other supported blocking modes.

The website domains you add to your Noxa blocklist may be stored and synchronized through Noxa's backend infrastructure, including Supabase, so that supported website-blocking configuration can be associated with your account. Privacy-sensitive Apple Screen Time web-domain tokens and enforcement state remain device-local.

Website blocking is subject to Apple's supported web-content restriction capabilities, domain limits, browser behavior, and operating-system rules.

Noxa does not guarantee that every URL, subdomain, embedded web view, browser, VPN configuration, or future browsing technology will be blocked under every circumstance.

9. Subscriptions and Billing

Noxa offers auto-renewable subscriptions through Apple's App Store.

A subscription provides access to Noxa as a software product and service, including the Noxa features included in the plan presented at purchase. A Noxa subscription is not a separate purchase of, or fee for, access to Apple's Screen Time APIs or other Apple platform technologies.

Subscription Information

Before you purchase, the App Store purchase flow will display information such as:

• the subscription price;
• the billing period;
• the included Noxa features;
• renewal terms; and
• any applicable promotional offer.

Prices and available plans may change. The price and terms presented by Apple when you confirm the transaction govern that purchase.

Automatic Renewal

Unless you cancel in accordance with Apple's procedures, an auto-renewable subscription may renew automatically for the renewal period shown at purchase.

Apple bills your Apple Account according to the terms presented in the App Store.

Managing or Cancelling a Subscription

You can manage or cancel an App Store subscription through Apple's subscription-management interface.

Cancellation generally prevents a future renewal but does not necessarily terminate access before the end of an already-paid subscription period.

Account Deletion Does Not Automatically Cancel Billing

Deleting your Noxa account does not automatically cancel an App Store subscription.

Noxa provides access to Apple's subscription-management interface so you can separately manage or cancel your subscription.

Refunds

Purchases made through the App Store are generally subject to Apple's refund processes and applicable law.

Noxa does not independently control Apple's approval or denial of App Store refund requests.

Restoring Purchases

Noxa provides a way to restore eligible App Store purchases or entitlements where supported by Apple.

10. Subscription Access and Service Changes

Subscription access may depend on Apple's current entitlement information.

If a subscription:

• expires;
• is revoked;
• encounters a billing problem;
• is refunded; or
• otherwise ceases to provide an active entitlement,

Noxa may restrict subscription-dependent features.

Noxa may change, add, remove, or redesign features over time.

If a change materially affects a paid subscription, we will provide notice where required by applicable law or App Store rules.

Nothing in these Terms limits mandatory consumer rights that cannot lawfully be waived.

11. Acceptable Use

You may use Noxa only for lawful, personal purposes consistent with these Terms.

You may not:

• use the Service in violation of applicable law;
• attempt to gain unauthorized access to Noxa systems or another user's account;
• interfere with, overload, attack, or disrupt the Service;
• use automated systems to abuse Noxa infrastructure;
• attempt to extract credentials, secrets, or other protected backend information;
• misuse the Service to harm, harass, stalk, or control another person;
• use Noxa as an unauthorized device-management system for another person;
• copy, modify, distribute, or create derivative works from proprietary Noxa software except as permitted by law or applicable open-source licenses;
• reverse engineer or attempt to derive source code except where such restriction is prohibited by law; or
• circumvent security or access restrictions imposed to protect the Service.

We may investigate suspected abuse and take reasonable action to protect Noxa and its users.

12. Your Configuration and Content

You may provide information to Noxa when configuring or using the Service, such as:

• website domains you choose to block;
• focus preferences and configuration;
• account information; and
• support, privacy, or other communications you send to us.

Privacy-sensitive Screen Time selections, tokens, and enforcement state remain stored locally on your device as described in our Privacy Policy. Website domains that you choose to block may be stored and synchronized through Noxa's cloud services, including Supabase.

You retain any rights you have in information you provide.

You give Noxa the limited rights necessary to process information you provide solely to operate, secure, maintain, and support the Service in accordance with our Privacy Policy.

You represent that information you submit does not violate applicable law or the rights of others.

13. Privacy

Our Privacy Policy explains how we handle personal information.

The Service involves both device-local information used for Screen Time enforcement and cloud-backed account, focus-session, and supported website-blocking configuration used to provide Noxa services.

Noxa does not treat these Terms as permission to use Apple Screen Time data for advertising, data-broker purposes, or any other use prohibited by Apple's applicable terms.

14. Third-Party Services

Noxa depends on third-party platforms and service providers, including:

• Apple; and
• Supabase, which supports authentication, backend services, focus-session history, and synchronization of supported website-domain blocklist information.

Third-party services are governed by their own terms and policies.

Noxa is not responsible for failures caused solely by third-party services outside our reasonable control, although this does not affect rights you may have under applicable consumer law.

15. Apple-Specific Terms

If you download Noxa through Apple's App Store:

1. These Terms are between you and Deepak Kolli, operating Noxa, not Apple.
2. Apple is not responsible for providing maintenance or support for Noxa except as required by applicable App Store terms.
3. Your license to the iOS application is also governed by the Apple Standard EULA unless Noxa provides a valid custom EULA through App Store Connect.
4. Apple and its subsidiaries may be third-party beneficiaries of applicable terms governing your licensed use of the iOS application to the extent provided by the Apple Standard EULA or App Store terms.
5. Purchases and subscriptions made through the App Store are also subject to Apple's applicable payment, billing, cancellation, and refund terms.

If any provision of these Terms conflicts with mandatory Apple App Store terms applicable to distribution of the iOS application, the mandatory App Store term controls to the extent of that conflict.

16. Intellectual Property

Noxa, including its software, branding, interfaces, graphics, text, designs, and other proprietary materials, is owned by Deepak Kolli or his licensors and is protected by applicable intellectual-property laws.

Except for the limited rights necessary to use the Service under these Terms and the applicable EULA, no ownership rights are transferred to you.

"Noxa," its logos, and related branding may not be used without permission except where permitted by law.

17. Feedback

If you provide ideas, suggestions, or feedback about Noxa, you grant us permission to use that feedback to improve or develop the Service without an obligation to compensate you.

This section does not transfer ownership of your personal information or other content that is unrelated to feedback.

18. Availability and Reliability

We work to make Noxa reliable, but the Service may occasionally be unavailable or behave unexpectedly.

Examples include:

• iOS updates;
• Screen Time framework behavior;
• App Store service outages;
• Supabase or network outages;
• device restarts;
• permission revocation;
• bugs in Noxa or third-party software; and
• maintenance.

We do not promise uninterrupted or error-free operation.

If a technical failure results in a material problem with a paid service, any remedy is subject to applicable law and the purchase or refund mechanisms available through Apple.

19. Not Medical, Psychological, Safety, or Emergency Advice

Noxa is a productivity and digital-wellbeing tool.

It is not:

• medical care;
• mental-health treatment;
• psychological diagnosis;
• addiction treatment;
• emergency assistance;
• parental supervision;
• cybersecurity protection; or
• a safety-critical device-management system.

Any statistics provided by Noxa are informational only.

If your device usage is causing serious distress or affecting your health or safety, consider seeking appropriate professional support.

20. Suspension and Termination

You may stop using Noxa at any time.

You may delete your account using the in-app account-deletion process.

We may suspend or terminate access to the Service if reasonably necessary because:

• you materially violate these Terms;
• your use creates a security or legal risk;
• you abuse the Service;
• we are required to do so by law; or
• operation of the Service becomes unlawful or impracticable.

Where reasonable and legally required, we will provide notice before termination.

Termination or deletion of your Noxa account does not itself cancel an App Store subscription.

21. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Noxa is provided on an "as is" and "as available" basis.

We do not warrant that:

• Noxa will always be available;
• every block, timer, threshold, or usage limit will function without interruption;
• Noxa will prevent every possible method of bypassing a restriction;
• third-party services will always operate correctly; or
• the Service will meet every user's particular productivity goal.

Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

Nothing in these Terms excludes warranties or consumer protections that cannot legally be excluded.

22. Limitation of Liability

To the maximum extent permitted by applicable law, Deepak Kolli, operating Noxa, and Noxa's contractors and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the Service.

To the maximum extent permitted by law, our total aggregate liability arising from or relating to the Service will not exceed the greater of:

• the amount you paid for Noxa during the 12 months before the event giving rise to the claim; or
• USD $100.

These limitations do not apply where liability cannot lawfully be limited, including any liability that applicable consumer law requires us to bear.

23. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Deepak Kolli, operating Noxa, from claims, losses, and expenses arising from your unlawful misuse of the Service or material violation of these Terms.

This section does not require you to indemnify Noxa for Noxa's own unlawful conduct or where such an obligation is prohibited by consumer law.

24. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict-of-law principles, except where the mandatory law of your place of residence applies.

Subject to mandatory consumer rights, disputes relating to these Terms or Noxa may be brought in a court of competent jurisdiction located in Massachusetts.

If applicable law gives you the right to bring a claim in another forum, these Terms do not take that right away.

25. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we will update the "Last Updated" date and provide additional notice where required.

Changes will not retroactively remove rights that applicable law does not permit us to remove.

26. Severability

If a court or other authority finds part of these Terms unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

27. Entire Agreement

These Terms, our Privacy Policy, the applicable Apple Standard EULA or custom EULA, and any additional terms presented for a specific Noxa feature form the agreement governing your use of the Service.

If feature-specific terms conflict with these Terms, the feature-specific terms control for that feature to the extent stated.
